Panellists on IPWatchdog’s Artificial Intelligence (AI) Master Program had a debate on where AI belongs in intellectual property law and how the laws on who can be an inventor/author/creator need to adapt with the advances in technology. Will ChatGPT change the law on AI?
The panel included Professor Ryan Abbott who is representing Stephen Thaler in his cases involving the AI machine, DABUS in the US, and other regions. Abbott said that the law must eventually evolve and adapt to accommodate AI inventors and authors. An example he brought up is ChatGPT where he said that technology is already at a point where AI has started creating work independently. Before we talk about Will ChatGPT change the law on AI? – we must talk about what it is.
What is ChatGPT?
ChatGPT is a natural language processing tool that is driven by AI technology. It allows the user to have human-like interactions/conversations with a chatbot. The AI system can model answers to question that the user may ask and assists with tasks such as composing emails, essays, and code. It has already made a huge impact as the app had acquired 1 million users within the first 5 days of its launch and as of January, 2 months after its launch it had 100 million users. This can be compared to TikTok which took 9 months to reach 100 million users.
Should Intellectual Property protection be afforded to AI?
It can be argued that if the law continues to exclude and ignore AI it could restrict technological advancements as companies are less likely to invest into AI as it would be seen as an unnecessary risk due to protection not being afforded to the AI.
From a copyright perspective, Abbott explained that that the standard set for original work is quite low. He used this analogy:
“If I tell one of my students, go write three sentences for me on this conference, that work is protected by copyright and that is exactly what ChatGPT does, and it does it in no way that someone is directly contributing as an author to that work other than the machine. So, if you’re not going to allow that then you get rid of IP protection for an entire universe of invention [or creations].”
However, Christian Hannon had an opposing view which was that at the start of each AI creation there is human intervention. This can be through programming at the initial stage of the AI creation as the starting point is from large data sets which need to be arranged for the AI to generate work.

Another panellist argued that it will be at least 15 years before AI develops to the point that it may be considered conscious or aware and that the law will have to adapt quickly.
ChatGPT is one of the many AI inventions that are knocking on the door of intellectual property protection. It is clear that our technology has surpassed our legislation and morality therefore it is crucial to understand what the technology is and how it can be incorporated in law.
