The Copyright Dispute concerned Post Malone’s 2019 song ‘Circles’, where Tyler Armes from the band ‘Down with Webster’ alleged that he co-wrote the melody and provided input on the bassline back in 2018.
When the song was released, Tyler Armes was offered a 5% share of the royalties. Negotiations in relation to the share of royalties then occurred between Armes and Post Malone’s manager. Armes sought for a higher percentage of royalties which was refused and the initial offer of 5% was removed.

As a result, Tyler commenced legal proceedings for co-writer and co-producer credit and royalties. District Judge Otis D. Wright II ruled in April 2022 that Armes did not have a claim for ownership in the commercial release but had a general dispute in relation to authorship.
The trial was supposed to take place on 21 March 2023 when jury selection began and was expected to run for four days. However, on 22 March 2023 District Judge Otis D. Wright II announced that the parties had reached a settlement to avoid trial.
What are the benefits of Settling a Case?
Settling a case may benefit the party that is paying damages as it may be a lesser amount than what a Judge or Jury would decide and it also will reduce legal costs as barristers or legal representatives will not be attending the hearing.
It can be more cost effective and leave the parties in a better position than if the case went to court and it may be a quicker way of resolving the dispute.
It does depend on the disposition of the client and the strength of the argument presented. There are certain circumstances where settlements or other forms of dispute resolution will be futile and the only way to resolve the matter will be through legal proceedings.
