One of the most common mistakes Ellis sees is businesses launching a brand before checking if the name or logo is already in use.

“We’ve had clients come in, fully trading under a brand, website built, socials running — and then they get a cease-and-desist. It’s painful and expensive to start over.”

A simple trademark search can avoid these headaches. You can run preliminary checks through the UK Intellectual Property Office or talk to a solicitor to conduct a deeper, more reliable search.

The Myth of Worldwide Trademarks

Another common misunderstanding is the belief in a “worldwide trademark.” Ellis is clear: no such thing exists.

“Trademarks are registered by jurisdiction — UK, EU, US, and so on. If you’re trading globally, you need to register in each market.”

This becomes especially important as your business grows and enters international markets. Failing to protect your brand in the right countries can lead to copycats and brand dilution.
