Facing Online Harassment and Defamation? Here’s What You Need to Know

In today’s digital age, online platforms are a breeding ground for harassment and defamation. From negative online reviews to targeted personal attacks, the internet can quickly become a hostile environment — both for individuals and businesses. At Lawdit Solicitors, we regularly assist clients who find themselves in the crossfire of online abuse and reputation-damaging content.

What is Online Harassment?

Online harassment refers to a pattern of unwanted, persistent behaviour that causes distress or alarm. It can include abusive messages, stalking, trolling, or even malicious reviews. The legal distinction is important: while a one-off offensive post might not qualify as harassment, repeated and targeted conduct often will.

In the UK, the Protection from Harassment Act 1997 allows victims to take legal action if the harassment is severe or persistent enough to cause anxiety or fear.

Civil vs Criminal Harassment: What’s the Difference?

  • Criminal harassment: Reported through the police, usually when there’s a risk to safety or persistent fear or distress.
  • Civil harassment: A legal claim brought via the civil courts, where the victim seeks an injunction (to stop the behaviour) and/or damages (compensation).

Many cases of online abuse fall under civil law, especially when they affect reputations or business operations but don’t involve threats of violence.

Understanding Defamation in the Online World

Defamation occurs when someone publishes a false statement that damages another’s reputation. Online platforms like forums, social media, and review websites are common spaces where defamatory statements are posted. In legal terms, there are two types:

  • Libel (written defamation – including online content)
  • Slander (spoken defamation)

If someone publishes a false and harmful statement about you or your business online, you may have grounds to bring a defamation claim — provided you can prove the statement was untrue, caused serious harm, and wasn’t protected under fair comment or truth defences.

What is a Norwich Pharmacal Order?

A common challenge with online defamation is anonymity. What happens if you don’t know who’s behind the post?

Enter the Norwich Pharmacal Order (NPO). This is a court order that compels third parties (like Google, Meta, or web hosting companies) to disclose information about the person responsible for the defamatory or harassing content.

Obtaining an NPO can be a powerful tool in unmasking anonymous trolls, but it must be handled correctly and with sufficient legal justification. Our team at Lawdit can assist with applying for this order and advising on whether it’s the best course of action in your situation.

Reputation Management: Not Just for Celebrities

Your online reputation matters — whether you’re a small business, a public figure, or just someone trying to live in peace. If you’ve been targeted by negative online reviews, fake accounts, or aggressive social media threads, there are legal avenues you can explore.

Our approach includes:

  • Reviewing the content for potential legal action
  • Drafting takedown notices
  • Contacting platform moderators
  • Issuing cease-and-desist letters
  • Taking formal court action if necessary

What Should You Do If You’re Affected?

If you’re suffering from online harassment or believe you’ve been defamed, you should:

  1. Document everything – Take screenshots and save URLs.
  2. Avoid responding – Engaging can escalate matters or be used against you.
  3. Seek legal advice early – The quicker you act, the better your chance of stopping further damage.
