For more than 120 years Jack Daniels has used a distinctive square bottle containing whiskey. VIP Products who are the creators of the dog toys named ‘Bad Spaniels’ are America’s second largest dog toy company and are part of the $100 billion a year pet products market.
The product in question ‘Bad Spaniels’ is made in the same shape as the iconic Jack Daniels bottle and is decorated like the bottle as well. Moreover, on the label instead of promising 40% alcohol by volume, it promises “43% poo by volume, 100% smelly.” The chew toy is part of a collection of other dog toys known as Silly Squeakers which parodies other large brands.
Jack Daniels’ perspective
Jack Daniels is not amused with the parody created of their iconic whiskey bottle. It has tried and failed to stop VIP from selling the Bad Spaniels toy. The lower courts ruled that the chew toy qualifies as “expressive work” and therefore there was no infringement.

Jack Daniels argues that it licences its trade marks to preserve its reputation and that Bad Spaniels severely damages the reputation of Jack Daniels. The company contends that the lower courts are wrong to conclude that the Bad Spaniels dogs was simply “humorous” and deemed as “expressive work” which makes it immune to claims of infringement from Jack Daniels.

VIP response to Jack Daniel’s claims is that “Freedom of speech begins with freedom to mock.”
This implies that they believe that the reputation of Jack Daniels is not damaged and would not confuse consumers as there is no bottle of dog food being sold. It is a pretend trade mark on a pretend label for a pretend bottle full of pretend content and that the entire thing is a parody according to VIP’s lawyer.
Conclusion – U.S. Supreme Court
It can be argued that if the ruling is allowed to stand then anyone can use a famous trade mark to sell derogative products which is not what the trade mark stands for. This would mislead consumers and damage the reputation of the trade mark significantly. Additionally, the other party may be able to argue that it is simply a parody.
