US Olympic Committee take on Prime Drinks over latest special edition

The US Olympic and Paralympic Committee has filed a trade mark infringement claim against Prime Drinks for including Olympic related imagery and phrases on latest edition without permission.

Prime, owned by YouTuber giants KSI and Logan Paul, have released a new version of their viral drink in collaboration with the basketball star and three-time Olympic gold medallist Kevin Durant.

The Committee is in control of the US Olympics departments for each sport who control the USA’s involvement in each Olympic games. As part of this role, the Committee own all the trade marks protecting the names and logos for each sporting department, and any logos relating to the upcoming games.

It is the Committee’s position that the labelling and the marketing for the drink is in breach of their registered trade marks. The claim filed notes that a cease and desist letter was sent before the claim was filed, but such was ignored by Prime and their marketing did not change.

The claim states that the Committee is concerned that the public may be misled into believing that Prime has been endorsed by the Committee, as they have done with other beverage brands.

There has been no comment by Prime in reaction to the claim or any indication as to whether they will fight it. With the Olympics only a matter of days away, the Committee will want to put a lid of this matter as quickly as possible.
