UK has sought at various stages to implement the EC Designs Directive (98/71/EC) which aimed to harmonise the substantive requirements for registered design protection in EU member states.
In the EU registered design law is governed by the Community Designs Regulation (6/2002/EC) (CDR). The Office for Harmonisation in the Internal Market (OHIM) which is known for the governance of trademarks,accepts applications for Community registered designs from January 2003.
In the UK, the law is governed by the Registered Designs Act 1949 (“RDA”). This has been amended in three pieces of legislation
1. The Copyright, Designs and Patents Act 1988 (“CDPA”),
2. The Registered Designs Regulations 2001 (SI 2001/3949) (“RDR”),
3. The Regulatory Reform (Registered Designs) Order 2006 (SI 2000/1974) (2006 Order).
