Emelike Nwosuocha, professionally known as Kidd Wes, has just filed a copyright infringement lawsuit against Childish Gambino over his Grammy-winning track “This Is America”. Rapper Wes has based the suit on claims that the song infringed on his own 2016 hit, named “Made in America”. The suit was filed in a New York federal court on the 6th of May.
Additionally, the allegations of infringement have targeted numerous other defendants, including co-writer Young Thug, producer Lüdwig Goransson, Kobalt Music, Sony Music Entertainment and many more. Wes first uploaded his track on SoundCloud back in 2016, which was later included in his album Eleven: The Junior Senior Year. The Claimant’s legal team have stated that the similarities between the two songs are beyond coincidental, insisting that copyright infringement has occurred.
Kidd Wes is seeking credit and compensation for the unauthorised use of his music track. His team are also requesting damages from profits made through record sales, ringtones, endorsements and more. This is not the first time someone has claimed copyright theft over the Gambino song in question. Back in 2018, rapper Jase Harley insisted that the track largely resembled his own “American Pharoah” song, in a now-deleted tweet.
