How to protect your designÂ

Notwithstanding the upload facility we offer@ Under UK law there is no requirement for articles to be marked and there is no (d) equivalent to the copyright symbol.

However it is good advice for you to mark the design with “Design Right”, your name, and the year of first marketing

We advise this as it will act as a deterrent to potential infringers and assist in preventing a manufacturer from establishing that it did not know that the design existed and had no reason to believe that design right existed and secondly it will assist in preventing an importer or a wholesaler from establishing that your only remedy is damages not exceeding a reasonable royalty as again it did not know of the design.Â
