Pirate movie streaming sites legal in Italy

A €600,000 ruling against four unlicensed streaming websites has been overturned by the Court of Appeal in Rome. It was found that simply providing links to files protected by copyright does not qualify as distributing files, notwithstanding the fact that the sites created income by way of advertising.

The operator of the four streaming sites in question was found guilty of copyright infringement by a local court in Italy back in 2015. The court ordered that the operator pay almost €600,000 in fines and costs. Subsequently the four sites were shut down however an appeal was filed by the sites operator.

Fulvio Sarzana the lawyer on behalf of the streaming sites operator has explained “The Court ruled that the indication of links does not qualify of making a direct disposal of files protected by copyright law”. The court found this notwithstanding that the sites generated income through advertising banners. Â

This decision is sure to be a controversial one, it has been reported by the Secretary General of the Federation for the Protection of Audiovisual and Multimedia Content that the traditional legal routes are not the only way to tackle the ongoing piracy problem.Â
