Larry Flint Wins Trade Mark Case

It has been reported this week that Larry Flint has won a Federal Trade Mark Infringement case against his nephews.

Larry Flynt took action against his nephews Jimmy Junior Flynt and Dustin Flynt over the use of the Flynt name on adult movies.

It was argued that the use of the name tarnished the Flynt brand and caused confusion amongst the consumer. However it was counter argued that the use of one’s own name cannot be prevented and that the consumer was too careful and discerning to be confused.

However after the submission of survey evidence the Jury ruled in favour of Larry Flint.
