Instagram Copyright trouble for Khloe Kardashian

The famous family are having yet another brush will IP law.

Khloe Kardashian of reality TV family stardom has been hit with a copyright shaped problem after a photo she posted on the social media site Instagram.

The photo in question was of her and one of her famous sisters in Miami, Florida in a restaurant posted in September 2016.

The claim has been made by Xposure Photos who are the owners of the photo. They created an exclusive license for the photo with UK newspaper, the Daily Mail.

In the use of the image, Xposure states that Kardashian has removed the copyright management information from the image before posting as her own on Instagram.

The claim stated

“The photograph is highly creative, distinctive, and valuable. Because of Kardashian’s celebrity status, and the photograph’s quality and visual appeal, plaintiff (and the photographer it represents) stood to gain licensing revenue from licensing the photograph,”.

The claim askes for damages, any profits made, an interim and permanent injunction, as well as further damages for the removal of the copyright information.

This case made lead to another look at rights over a celebrity’s image and whether the person has the right to use a photo of themselves no matter if the copyright is owned by someone else.
