The Getty Images Stability AI High Court Case

In a landmark case that has garnered widespread attention, Getty Images Inc. has taken legal action against Stability AI, the creators of the deep-learning AI model Stable Diffusion, at the High Court. Getty Images accuses Stability AI of unlawfully using millions of its copyrighted images to train Stable Diffusion, sparking a heated debate over copyright infringement, trade mark violations, and the legal challenges posed by AI technology.

The Allegations

Getty Images’ lawsuit centres on claims that Stability AI “scraped” vast quantities of images from Getty’s websites without authorization. These images were allegedly used to train Stability AI’s Stable Diffusion, which then produced outputs accessible in the UK through various platforms, including Stability AI’s Dream Studio. According to Getty, the AI-generated images not only replicate a significant portion of Getty’s copyrighted works but also incorporate Getty’s trade marks, constituting a clear infringement of their intellectual property rights.

Claims and Defence

In addition to copyright and trade mark infringement, Getty accuses Stability AI of passing off and violating database rights. Stability AI, in response, attempted to have the case dismissed on summary judgment grounds, arguing there were no grounds for the claims. However, the judge has decided that the case possesses substantial merit to proceed to trial, dismissing Stability AI’s request for summary judgment.
