Even the UKIPO can get it wrong. The dangers of cut and paste
In a recent Invalidity Application in the name of Pass J Holdings Ltd in relation to trade mark registration no.2512671 a case came before Geoffrey Hobbs QC sitting as an Appointed Person. The filed mark was declared invalid.
However the trade mark proprietor appealed claiming amongst other things serious procedural irregularity as the Officer who made the decision had cut and pasted earlier decisions resulting in the insertion of incorrect dates of registration of various marks.
A re hearing was ordered and although the Appointed Person could not award costs he said he would if he could.
Cut and Paste is great but it can risky too!
