Weight Watchers Gets Tough with Nestle

Nestle has been sued by the weight loss company Weight Watchers. The suit claims that Nestle’s frozen food packaging infringes Weight Watchers trade marks.

According to the lawsuit, filed in New York court last week, Nestle is being accused of misusing the Weight Watchers trade mark by improperly displaying it on sites and packaging of diet frozen foods and desserts. The products also allegedly infringe Weight Watchers’ “points” weight-loss system trade mark.

The suit is mainly concerned with Nestle’s “Lean Cuisine” and “Skinny Cow” brands which specifically target consumers who are concerned with losing weight and adopting a healthy lifestyle – the same people who Weight Watchers target audience.

Weight Watchers claims that Nestle is misleading consumers by associating itself with Weight Watchers who are seeking unspecified damages, punitive damages and an injunction in relation to the infringement.
