The main statute governing registered designs in the UK is the Registered Designs Act 1949 RDA. It has, however, has been substantially amended three times in recent years by the Copyright, Designs and Patents Act 1988 (CDPA), the Registered Designs Regulations 2001 (SI 2001/3949) (RDR) and by the Regulatory Reform (Registered Designs) Order 2006 (SI 2000/1974) (2006 Order). The changes have led to four types of design registration: Designs applied for on or after 1 October 2006 (“new designs”) Designs applied for between 8 December 2001 and 30 September 2006 (“post-2001 designs”) Designs applied for between 1 August 1989 and 8 December 2001 (“post-1989 designs”) Designs applied for before 1 August 1989 (“pre-1989 designs”).
