Spammers beware!

The Criminal Justice and Immigration Bill, has brought the introduction of custodial sentences for offences for the misuse of personal data under section 55 of the Data Protection Act 1988 (DPA) a step closer.

In line with the government’s recommendation on the new penalties, the Bill provides for a custodial sentence of up to 12 months on summary conviction (with a six-month maximum sentence for offences committed before section 282(1) of the Criminal Justice Act came into force) and up to two years’ imprisonment for a conviction on indictment.
