Before you take civil action against another person or company via the County Court it is important to consider the issues of costs
Potential claimants are often put in a difficult position when deciding how to tackle a bad debt or how to claim damages against someone. I say this because quite often, the fees involved in recovering a debt, or taking an action for damages, can often outweigh the sum claimed
So what is the position in the county court? This all rests on how much the claim is for.
If the claim is for a sum below £5000.00 then you cannot recover any legal fees. If the sum is over £5000.00 the it may be possible.
So it stands to reason that you must consider (especially if instructing a solicitor) whether the costs (and in effect the time) involved is worth the sum claimed.
