Burberry v TJ Maxx et al

It has been reported that three stores operated by TJX Cos (TJ Maxx, Marshalls and HomeGoods stores) are subject to a legal action by Burberry.

It is believed that action is being taken against the cut price stores for trade mark infringement over the sale of products such as clothes, luggage and jackets, Whilst the details are yet to be released it would appear that the action will be based on the use of the Burberry pattern rather than its name although this not yet confirmed.

Burberry are reportedly asking TJ Maxx to destroy the offending merchandise and publish advertisements making it clear that the products are not Burberry products.
