The U.S. Patent and Trademark Office had accepted the application by Qualcomm Inc. to re exam a patent owned by Broadcom Corp. This is the conclusion after a dispute between the two companies over a computer chips used in mobile phones.
The patent was under threat when Broadcom Corp. served a claim for patent infringement before the U.S. International Trade Commission against Qualcomm. An administrative law judge in that claim said this month that Qualcomm had not infringed the Broadcom patent. However, the judge found that Qualcomm had infringed a second Broadcom patent.
The US patent office said it would look at whether there were previous inventions or other information that might affect the first Broadcom patent.
On this basis, Qualcomm now requests the Office to re-examine the patent in the hope that it may be stuck out or withdrawn from the database of registered patents.
