The organisers and creators of the hugely successful music festival ÂCoachellaÂ has issued proceedings against a newer established festival named ÂHoodchellaÂ in the California Federal Court.
Coachella Music Festival LLC and their producer, Goldenvoice LLC, are seeking $100,000 and a complete abandonment of the name after they found that Hoodchella had been continuing business with a very similar name.
They believe that by using this name their trade marks have been infringed and diluted. Also they claim there has been a creation of unfair competition through its use.
They have also claimed that Kamil al Ahdali, the operator and advertiser for Hoodchella, purposely infringed as he knew of the similarity to the existing festivalÂs brand. They state he has unfairly profited from their common law rights as well as six registered trade marks.
Goldenvoice has said they previously asked Hoodchella to change their branding, a request that was refused.
This may call an end to a newly emerging festival who has just released tickets for their event this year.
